My friend was sentenced to 365 days with credit for time served. He was on the ankle monitor for over 5 months and on probation for 3 months on that charge. His defender is saying that none of that time counts. His max sentence is 365 days. How can that not count?

Will they set you up on the ankle monitor with magic jack? Our land line has fax and call waiting so I dont know if we can use it. so I thought maybe th magicjack could be an option.
